The Service and its original content, features, and functionality are owned by WhaleTools and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain all rights to content you upload to the Service. By uploading content, you grant us a worldwide, non-exclusive license to use, host, and display that content for the purpose of operating and providing the Service.

In the event we fail to meet our uptime guarantee, you may be eligible for service credits as outlined in our SLA documentation.
Your use of the Service is also governed by our Privacy Policy. We take data protection seriously and implement industry-standard security measures. You are responsible for ensuring your use of the Service complies with applicable data protection laws, including GDPR and CCPA.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.
You may terminate your account at any time by contacting us. Upon termination, we will provide you with an export of your data within 30 days.
To the maximum extent permitted by law, WhaleTools shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
You agree to indemnify and hold harmless WhaleTools, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.
Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
